Recent project experience

Construction-technology integration

  • project counsel for an 18 month project for a global Automated Storage and Retrieval System (ASRS) OEM to deliver two robotic customer fulfilment centres for an Australian supermarket client. Worked with the project executives and site teams in Victoria and NSW, and the Global Delivery Director, Group General Counsel to develop defensive strategies to overcome delivery challenges and to achieve successful completion.
  • drafting and negotiating development and construction contracts for a VIC ASRS facility.
  • drafting and negotiating aevelopment, supply & installation, construction agreements for a national parts supplier delivery of ASRS warehouses in Queensland and Victoria.
  • drafting project, engineering and IP agreements for a floating storage regassification unit project in Australia.
  • drafting construction management and supply agreements for an Australian data centre project.
  • advising a global MRI OEM on an equipment supply and building upgrade project at a QLD Hospital.
  • preparing tender departures for a global technology OEM on roadside tolling system, video tolling and tolling systems projects in NSW, Victoria and Singapore.

Renewables

Ehren has helped to deliver, and worked on, more than 6 GW of renewables projects in Australia, Asia Pacific and India:
  • development of a 60MW wind farm in Victoria.
  • negotiations for development agreements, EPC, O&M, TSA, LTSA and project agreements for a 250MW, BESS and transmission line in South Australia, a 1200MW wind farm in Queensland, a 210MW wind farm in South Australia, and a 95MW wind farm in New Zealand.
  • advising owners on construction agreements for a pumped hydro and 75MW BESS in NSW, and a 115MW BESS in Victoria.
  • advising financiers on EPC, O&M, execution disputes and contract admin for a 250MW wind farm in NSW, a 120MW wind farm in South Australia , a 225MW wind farm in Victoria, and 500MW and 125MW solar farms in Queensland.
  • advising contractors on a 250MW solar farm in South Australia, and a 55MW solar farm in Queensland. 
  • negotiations and settlement of LTSA / O&M disputes on a 430MW wind farm in Victoria and a 175MW wind farm in New Zealand.
  • tendering and negotiations for a 200MW wind farm in Victoria, a 500MW wind farm in Queensland, and various 10-25GW off-grid projects in Western Australia.
  • negotiations to NTP, contract management during execution, through to handover and LTSA phase for projects in Korea (75MW, and multiple 5-15MW, wind farms), India (165MW wind farm), Indonesia (75MW and 70MW wind farms), Japan (125MW wind farm), Philippines (20MW, 160MW, and 80MW wind farms), and Vietnam (120MW, 100MW, 75MW, 90MW, 125MW, and 30MW wind farms).

Selected project experience

Commercial

  • drafting a national procure/supply, install and construction contract for a global healthcare OEM.
  • drafting project agreements and advising on the structure of a transport network signalling integration project for a government department.
  • Commercial Manager for Australia, and Senior Legal Counsel for Asia Pacific and India, at a wind turbine OEM. Worked on many regional wind farm construction and O&M phase projects, including contract management, payment claims, developing and defending claims, and initiating, defending and settling disputes, and renegotiating contracts.

Execution / completion phase

  • advising on the dispute strategy and communications plan to bring and resolve a $1b PPP dispute in NSW for a contractor.
  • advised an Australian public company on FIDIC contracts for a Mozambique tailings and processing facility and complex disputes.  Seconded to site in Mozambique to work with the project team, conduct settlement negotiations, resolve claims and complete the project.
  • advising a water treatment plant SPV on a complex dispute with mine owners and the O&M contractor on a DBO&M project and working closely with the executive and project teams through the project lifecycle.

Disputes

  • advising an EPC contractor on an up- and downstream dispute on a network transmission construction project.
  • advising a contractor on $100m+ delay and breach of contract claim against a technology contractor JV partner on a renewables project in WA.
  • advising an energy distributor on successful resolution of a services contract dispute with a retailer in the NSW Supreme Court, and briefing senior counsel.
  • advising the employer on a gas pipeline arbitration with the contractor, involving $1b claims for damages, prolongation and quantum meruit, including taking witness statements and drafting submissions.
  • security of payment adjudications, preparation of payment claims and schedules to comply with contract and law, and claims under the Consumer Law, calling on security and working with financiers.
  • acting for a senior Vatican member at the Royal Commission into Institutional Responses to Child Sexual Abuse, including briefing senior counsel and instructing during two hearings.
  • acting for a shopping centre owner defending claims brought under tenancy agreements following the failure and closure of the Melbourne Star Observation Wheel.
  • other experience in VCAT, FWC, County Court, Magistrates Court, and Federal Court.

Publications

Coming in 2025, a chapter on strategic contract administration in a legal / project management textbook on incorporation of technology contracts into construction and infrastructure projects.
