Ehren Terenyi – Director
Ehren has worked in the construction industry for 24 years, and the last 12 years as a lawyer advising on project agreements, contract administration and dispute resolution. He works on large scale construction, energy, and technology-construction integration projects. Ehren has extensive experience on renewables, BESS and DCs and infrastructure projects, having helped to deliver over 10 GW of projects in Asia Pacific.

Critical infrastructure
- Advising Engineering contractors on tenders and contract admin for agreements for consultancy services for Government, utility and tunnel projects.
- Consultant projects advisor to two major multinational BESS developers working on development, land, procurement, delivery, offtake, operations, FID / FC, SOCI, FIRB, cyber and OT specifications and requirements.
- Developing a 60MW wind farm, drafting and negotiating exclusivity, options and leases with landowners, and investment partner tender process.
- Advising owners on project agreements on 16 BESS projects in Victoria, NSW, Queensland, South Australia, and connection, revenue, Capacity Investment Scheme and Firm Energy Reliability Mechanism, and data centres projects in Victoria, ACT and NSW.
- Advising contractors on consultancy / services/ D&C / O&M agreements for BESS, solar, wind, substation and data centre projects in Victoria (400MW), NSW, Queensland (1GW+) and South Australia.
- Tendering and negotiations for CIS, LTES and FERM tenders for BESS and wind farms, and 10GW+ off-grid hybrid renewable hub projects.
- Negotiating development, project agreements and dispute settlements, EPC, O&M, TSA, LTSA for wind farms in South Australia, Queensland, South Australia and New Zealand.
- Transaction team legal lead through to NTP, contract management during execution and operations phases for 20+ wind farm projects in Korea, India, Indonesia, Japan, Philippines, and Vietnam.
Commercial
- Advising an OEM on tenders for Operational Management and Control Systems and roadside and video tolling systems for various projects, including toll roads in NSW, Victoria, Singapore, and projects in ACT, Queensland, New Zealand, Philippines, and Thailand.
- Advising on strategy to navigate the discovery of combustible cladding from an overseas supplier.
- Advising the owner on project, engineering and IP agreements for a floating storage regassification unit project in Australia.
- Advising an OEM on an equipment supply and building upgrade project at a Queensland Hospital, drafting a national procurement, supply, install and construct contract, MSA negotiations with Victorian and NSW State health purchasing authorities.
Delivery
- Robotics project. Embedded full time in client’s project team to deliver two robotic customer fulfilment centres for an Australian supermarket, working with project executives and site teams in Victoria and NSW. Worked closely with Group Commercial Director and Group General Counsel to develop defensive strategies to overcome challenges encountered during delivery and to achieve settlement at Completion. Heavily involved in resolution of disputes including disputed certification requirements, fitness for purpose of operating environment for robots, claims regarding construction delay and defects, dangerous goods requirements, fire safety issues, workplace safety issues, insurance issues.
- Advising the development arm of a super fund manager on construction of a large ASRS warehouse in Victoria, drafting and negotiating property, construction and interface agreements.
- Advising a national parts supplier on negotiations for and delivery of two ASRS warehouses in Queensland and Victoria.
- Advising an engineering contractor on a defects claim on a PPP.
- Advising financiers on project agreements, EPC, O&M, execution disputes and contract admin for wind farms in Queensland, NSW, South Australia, and Victoria, and solar farms in Queensland.
Disputes
- Advised a PPP D&C contractor on strategy and communications to enable resolution of a dispute with the State.
- Advised a project owner on contracts for construction of railway and dispute concerning delays and defects on construction of a mine in Mozambique. Worked directly with Capital Project Manager and Superintendent and project team to close out the project and resolve claims. Seconded to site to resolve disputes at site level.
- Acted for a utility owner on successful resolution of NSW Supreme Court dispute regarding a services contract, and appeals to the Court of Appeal.
- Advised an infrastructure operator on a complex project set up, delivery disputes and eventual dispute with upstream owners and JV partner involving design, build, operate and maintain project. Worked closely with the executive team through commercial and contract negotiation, build phase, establishing operations and ongoing client and contract management. This included managing upstream and downstream claims regarding delay and defects, and SOPA claims.
- Advising an overseas EPC contractor on up- and downstream disputes on a network transmission construction project.
- Advising an overseas JV party on $100m+ delay and breach of contract claim against a technology JV partner on an infrastructure project.
- Advised an infrastructure owner on a pipeline arbitration with the contractor.
- Acting for a witness in hearings at a Royal Commission.
- Security of payment adjudications, preparation of payment claims and schedules to comply with contract and law, and claims under the Consumer Law, calling on security and working with financiers.
